App Terms of Service
Last updated October 13, 2026
These terms are an agreement between you and Project Almanac Inc. ("Farm::Local", "we", "us") and cover the Farm::Local iOS app, Android app and web app (together, "the app"). You agree to them when you create an account. If we update them, continuing to use the app means you accept the update. Our website, farmlocal.life, has its own website terms.
Who can use the app
You must be at least 13 to use the app, and at least 18 to buy, sell or manage a market. If you are under 18, a parent or guardian must agree to these terms for you.
The beta
Farm::Local is in beta. Features may change, break or be removed, and access is granted at our discretion. The app is provided "as is" while we build it.
Your account
- Give us accurate information and keep it current.
- Keep your login details secure. Each account is for one person.
- You are responsible for activity under your account.
Our role in the marketplace
Farm::Local connects buyers with independent farms, sellers and markets. When you buy something, the sale is between you and the seller. Farm::Local is not the seller.
Sellers are responsible for their products, including quality, food safety, labelling, allergen information, and any permits or licences they need. Farm::Local does not inspect, test or guarantee any product.
Orders and pickup
- You pay at checkout.
- You choose a pickup location and time. If your cart has items for different pickup locations, each location becomes a separate order.
- Prices and stock can change until you check out.
- If you don't pick up your order at the chosen time, the seller is not required to refund you or hold the order, although they may choose to.
- If a seller can't fulfil your order, they will cancel the affected items and you will be refunded for them.
Cancellations and refunds
- You can cancel an item in the app for a full refund until 24 hours before its pickup time. After that, you can't cancel it in the app.
- Sellers can cancel and refund items at any time.
- Refunds go back to your original payment method. How long they take to arrive depends on your card issuer, usually 5 to 10 business days.
- If you dispute a charge with your card issuer instead of contacting us, we may suspend your account while the dispute is open.
- If there's a problem with an order, contact the seller first through the app. If that doesn't resolve it, email support@farmlocal.life.
CSA subscriptions
- CSA subscriptions charge you automatically at the frequency you choose.
- You can pause or cancel at any time in My CSA Subscriptions. Cancelling stops future charges. Charges already made are not refunded unless the farm agrees.
- If a farm skips a delivery or ends its season early, you will not be charged for the missed delivery, or you will be refunded for it.
Seller terms
If you sell through the app, you also agree that:
- You will keep listings, stock, prices and pickup times accurate.
- You will fulfil orders, or cancel and refund them promptly if you can't.
- You will not misrepresent your products, your farm, or where your food comes from.
- Buyers pay the Farm::Local service fee at checkout, on top of your prices: 6% on marketplace orders and 9% on CSA subscriptions. In-person sales through Farm POS cost you 15¢ per sale. Stripe's processing fee (2.9% + 30¢ online, 2.7% + 5¢ in person) is deducted from your payouts at cost.
- You are paid through Stripe Connect, and you agree to the Stripe Connected Account Agreement. Payouts usually arrive within 2 business days, on Stripe's standard schedule. If a payout fails, Stripe will retry it once you update your payout details.
- Where New York law requires a marketplace to collect sales tax, Farm::Local collects it on your sales through the app and sends it to the state. You are responsible for all other taxes, including income tax and sales tax on sales made outside the app.
- If a buyer disputes a charge with their card issuer (a chargeback) and the dispute is decided against you, the amount and any dispute fee may be deducted from your payouts.
- You will cover claims, losses and costs that arise from your products, including food safety claims.
Market manager terms
If you manage a market through the app, you also agree that:
- You are responsible for approving vendors and for your market's own rules.
- Vendor fees and invoices are between your market and its vendors.
- Your market profile, schedule and booth maps will be accurate.
Fees
There is no charge to create an account or browse. When you buy, you pay a Farm::Local service fee at checkout: 6% on marketplace orders and 9% on CSA subscriptions. The fee is shown before you pay, and it is refunded along with any item you cancel in time. Seller fees are described above. We will tell you before any new or higher fee applies to you.
Your content
You keep ownership of what you submit, such as listings, photos, posts, reviews and messages. You give us permission to host and display it as needed to run Farm::Local. Reviews must be honest and based on your own experience.
Acceptable use
- Do not use Farm::Local for anything unlawful, misleading or harmful.
- Do not harass other users or send spam through messages.
- Do not try to break, overload, or gain unauthorized access to the app or other accounts.
- Do not sell prohibited items, including alcohol, tobacco, cannabis, live animals, raw milk where it is not legal, and anything else that is illegal where it is sold.
We may remove content and suspend or ban accounts that break these terms. To appeal a ban, email support@farmlocal.life.
Reporting
You can report a user or listing with the in-app report button, and report a bug with Report a Bug in the app. You can also email support@farmlocal.life.
Our content
The Farm::Local name, logo, app design and software belong to Project Almanac Inc. You may not copy or reuse them without our written permission.
Copyright complaints
If you believe content in the app infringes your copyright, email support@farmlocal.life with: your contact details; a description of the work; where the content is in the app; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them; and your physical or electronic signature. We will remove infringing content and end the accounts of repeat infringers.
Disputes between users
Disputes about orders, products, pickups or market rules are between the users involved. We may help, but we are not required to. To the fullest extent the law allows, you release Farm::Local from claims arising from those disputes. If you are a California resident, you waive California Civil Code section 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Disclaimers
To the fullest extent the law allows, we provide the app "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. We are not responsible for products sold by sellers, including their quality, safety or legality, or for the content and conduct of other users.
Limit on liability
To the fullest extent the law allows, Farm::Local is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the app. Our total liability for any claim is limited to the greater of $100 or the fees you paid to Farm::Local in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.
Indemnity
You will cover Farm::Local's claims, losses and costs, including reasonable legal fees, that arise from your content, your use of the app, your breaking these terms, or, if you are a seller, your products.
Ending access
You can stop using the app and delete your account at any time. We may suspend or end your access if you break these terms, or if we need to change or end the service.
Disputes and governing law
These terms are governed by the laws of the State of New York. If you have a dispute with us, contact us first and we will try to resolve it informally within 60 days.
If we can't resolve it, the dispute will be settled by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association, except that either of us may bring an individual claim in small claims court. You and Farm::Local each give up the right to a jury trial and to take part in a class action. You can opt out of arbitration by emailing support@farmlocal.life within 30 days of first agreeing to these terms. Any dispute not subject to arbitration will be heard in the state or federal courts in New York.
Apple App Store
If you downloaded the app from the Apple App Store:
- These terms are between you and Farm::Local, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you can notify Apple and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
- Apple is not responsible for claims relating to the app, including product liability claims, claims that it fails to meet legal requirements, consumer protection or privacy claims, or intellectual property claims.
- You confirm you are not in a country under a US embargo and are not on a US restricted list.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
General
- These terms and the policies they refer to are the whole agreement between you and Farm::Local about the app.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a part of these terms, we haven't given up the right to later.
- You can't transfer your rights under these terms. We can transfer ours, for example in a merger or sale.
- We aren't responsible for delays or failures caused by events outside our control.
Changes to these terms
If we change these terms, we will update the date at the top. If the changes are significant, we will tell you in the app or by email before they take effect.
